Negara wajib menjamin infrastruktur transportasi benar-benar mengusung jalan yang berkeselamatan. Artinya, secara gamblang ditegaskan bahwa seharusnya dalam pembangunan jalan, pengguna jalan wajib dibebaskan dari risiko kecelakaan lalu lintas jalan.
